Right of withdrawal for made-to-measure products

Under § 312g BGB, the statutory right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for which an individual selection or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer.

A withdrawal is therefore excluded for our made-to-measure curtains.

Cancellation period for made-to-measure products

You have the option to cancel the order for a made-to-measure product without giving reasons within 4 hours of receipt of the order. After that, your order enters production. Due to the individual manufacture, cancellation is no longer possible once production has started.

If you have purchased before sending us your final measurements ("buy-before-measure"), your order is held as a reservation. Production does not start, and is not charged beyond the deposit, until you confirm your measurements. You may cancel the reservation at any time before you confirm your measurements; we will refund any deposit paid.

Right of withdrawal for prefabricated products

Where we sell prefabricated items (e.g. accessories or samples that are not customised), you have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party other than the carrier nominated by you, take possession of the goods.

To exercise the right of withdrawal, you must inform us (Fupo Konzepte GmbH, Bautzener Straße 6, 10829 Berlin, Germany; email: mail@fupo-konzepte.de; phone: +49 30 629379944) by means of a clear statement (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send the communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of cancellation or withdrawal

If you withdraw from this contract, we shall reimburse all payments we have received from you, including delivery costs (with the exception of the supplementary costs arising from your choice of a type of delivery other than the cheapest type of standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive notification of your decision to withdraw from this contract.

For this reimbursement, we will use the same means of payment as you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees as a result of this reimbursement. We may withhold reimbursement until we have received the goods back, or until you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the prefabricated goods or hand them over to us, without undue delay and in any event no later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
